Bankruptcy 101, The Basics
Have you heard about the new bankruptcy law that took effect October 17, 2005? There is a lot of inaccurate information about the new bankruptcy law. Many of our clients have told us that Bill collectors have told them that bankruptcy is no longer available, that it doesn't exist or that bankruptcy is still available but that if our clients file, they will lose all their belongings. This is completely and absolutely NOT TRUE at all. These Bill collectors are simply trying to intimidate you and are only trying to deny you from gaining your Financial Freedom.
The biggest change with the new bankruptcy law is that it became more difficult for wealthier people to file under the Chapter 7 PLAN. However, the new law WILL NOT and HAS NOT affected the vast majority of San Antonians and our clients alike. Debt Elimination is still very much AVAILABLE and ACHIEVEABLE either with a Chapter 7 PLAN or with the Chapter 13 Debt Consolidation PLAN.
Consumer bankruptcy is a legal proceeding afforded to People and Small Businesses who are unable to pay their Bills as they come due. It is a legal process designed to help People and Small Businesses Eliminate or substantially reduce their Debt. Bankruptcy is also known as Debt Forgiveness. Bankruptcy is made available under the protection of federal law so that you can legally Get a Financial Fresh Start.™
After the Individual or Small Business files a bankruptcy (either a Chapter 7 PLAN or a C13-PLAN™), legal protections are ordered by the court that protects the Individual or Small Business so they may get their financial affairs back on track.
Title 11 of the United States bankruptcy code offers various forms of chapters of relief. The chapters most commonly used by People and Small Business are Chapter 7 and Chapter 13.
Coming to terms with your financial obligations should be commended and not viewed as failure, weakness or disgrace. In today's economy, anything unexpected has the ability to create an undue financial hardship on your financial well-being.
A C13-PLAN™ or a Chapter 7 PLAN may help you rise above your financial problems when, but not limited to:
- You lose your job or have a significant reduction in income.
- Your credit card Debt is difficult or impossible to continue to pay.
- You owe IRS Debt.
- You have unexpected medical Bills.
- You or a loved one is suffering from an illness.
- A divorce caused an income deficit.
- You have been sued by creditors.
- You have been threatened with lawsuits.
- You have fallen behind with your car payments.
- You have fallen behind with your house mortgage payments.
As soon as you file your PLAN, you are granted an automatic stay immediately that stops creditors from harassing you and making attempts to repossess, foreclose or collect on your Debt.
Remember the following guidelines in order to complete a successful C13-PLAN™ and/or a Chapter 7 PLAN: Always tell your attorney the truth concerning anything and everything pertaining to your case; list all of your creditors; don’t try to hide any asset(s) and/or income; complete all the required credit counseling sessions and finish making all agreed payments on time. Together as a team, we can succeed in bringing you DEBT RELIEF .
